General Terms and Conditions
1. Introductory Provisions
The whatspot internet application is operated by the business corporation ERGOTEP, družstvo invalidů, Company Registration Number: 25997815, with its registered office at: 25997815, registered in the Commercial Register maintained by the Hradec Králové Regional Court, Section "Dr", Entry no. 1084. (hereinafter also "the Provider"). The use of the application is intended for entrepreneurs in a B2B relationship. By creating a user account, you declare that you are not a consumer in the sense of Section 419 of the Civil Code.
The contract between the provider and the end user comes into existence by creating a user account and is governed by the provisions set out in these General Terms and Conditions and the provisions of Section 1746(2) of the Civil Code.
2. Our Services
The Freemium version
This is a free version of the tool which allows you to register, create an organization and subsequently create reservations. On the Price List page, you can find the current free versions’ features, which may change over time by expanding or narrowing based on the Provider's decision. If at least one new reservation is not created for a period longer than one year, the organization's account will be deactivated and all data will be deleted.
The Trial version
The Provider offers a free trial ("the Trial version") for 30 days. Here (see below) you can try the service with no restrictions. At the end of this period, you may decide whether to purchase the service or whether the Freemium version will suffice. In case of non-payment of the service fee and after the end of the 30-day Trial version, your user account will be automatically transferred to the Freemium version.

If you decide to use the paid version of our service, you can find the current features of this version on the Price List page.
3. The Premium Version
All services have a set price and scope. Their prices may be subject to adjustments to reflect market developments. Regular prices may also be temporarily replaced by promotional prices. An overview of prices is available on the Price List page.
Premium services can be ordered in the administrative part of your organization at any time during or after the Trial period.
Your subscription for the service lasts for the period you choose. The service you have purchased will be automatically renewed. If you wish to cancel your subscription, you can do so in your organization's administration.
If the subscription is not paid, the Premium version will be transferred to the Freemium version with all the resulting consequences.
5. Service Cancellation
If the subscription for the following period is not paid, your account will be automatically transferred to the Freemium tariff.
Payment for the service is made by credit card through a payment gateway. The payment date is determined on the basis of confirming a successful receipt of the amount in question by the payment provider. The payment date and activation date of the service are the same, except in cases where it is necessary to process the order manually. In case of manual processing, activation may be delayed.
The Premium service may be cancelled and a refund may be requested within 15 days of the day of activation. To request an order cancellation, you must send an e-mail request to the project support e-mail. No justification is necessary within the 15-day period. After the 15-day period, payment cannot be refunded. The service will be terminated automatically after the subscription ends. Payments will be refunded to the credit card used to order the subscription. Payment will be refunded within 50 days from the date of the request.
We may use the e-mail address you provided when you registered for the service to send information for this service.
You are responsible for ensuring that all registration information you provide is valid, accurate and current. You are responsible for maintaining your username and password’s security.
8. Deleting Data
The Provider reserves the right to regularly delete reservations and notifications with an event end date older than 24 months from the whatspot system, and is not liable for any damage caused by deleting this data. As a user of the service, you agree to back up all information contained in the whatspot service the loss of which could cause you harm outside the whatspot service.
The Operator reserves the right to delete any data entered into the whatspot service containing illegal, offensive or pornographic content or content subject to intellectual property you are not authorized or licensed to use. Assessing whether the content entered meets the above criteria is the sole responsibility of the operator.
9. Service Availability
Access to our services is provided on a temporary basis and we reserve the right to cancel, terminate or modify the service at any time without prior notice. We are not responsible for the service being unavailable for any reason. Our goal is to alert subscribers to any significant changes to the services.
Whatspot only offers support by e-mail. It is a self-service system, which means that our customers adjust the system according to their needs.
If you need help with technical issues or with random questions concerning a specific setting, you can contact our e-mail support. You are responsible for ensuring that the information you provide to our customer service is accurate. Whatspot is not responsible for the consequences of any action based on any advice provided by customer service.
The Operator is not liable for any loss or non-material damage caused by or in connection with the use of whatspot services or their unavailability, or the deletion or leakage of data entered into these services.
